Who is responsible for data collection on this website?

Data processing on this website is carried out by the website operator. You can find their contact details in the section "Information on the controller" in this privacy policy.

How do we collect your data?

Your data is collected, on the one hand, by you providing it to us. This may, for example, be data you enter into a contact form.

Other data is collected automatically or with your consent when you visit the website, through our IT systems. This is primarily technical data (e.g., internet browser, operating system, or time of the page request). This data is collected automatically as soon as you enter this website.

What do we use your data for?

Part of the data is collected to ensure the website is provided without errors. Other data may be used to analyze your user behavior. Insofar as contracts can be concluded or initiated via the website, the transmitted data is also processed for contract offers, orders, or other order requests.

What rights do you have regarding your data?

You have the right to receive information free of charge at any time about the origin, recipients, and purpose of your stored personal data. You also have the right to request the correction or deletion of this data. If you have given your consent to data processing, you can revoke this consent at any time with effect for the future. Furthermore, under certain circumstances, you have the right to request the restriction of the processing of your personal data. You also have the right to lodge a complaint with the competent supervisory authority.

You can contact us at any time regarding this and other questions on the subject of data protection.

Cloudflare offers a globally distributed content delivery network with DNS. Technically, the transfer of information between your browser and our website is routed through Cloudflare's network. This enables Cloudflare to analyze the data traffic between your browser and our website and to act as a filter between our servers and potentially malicious data traffic from the internet. In doing so, Cloudflare may also use cookies or other technologies to recognize internet users, which are, however, used solely for the purpose described here.

The use of Cloudflare is based on our legitimate interest in providing our web offering as error-free and securely as possible (Art. 6 (1) (f) GDPR).

The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details and further information on the subject of security and data protection at Cloudflare can be found here: https://www.cloudflare.com/privacypolicy/.

The company is certified under the "EU-US Data Privacy Framework" (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information on this can be obtained from the provider at the following link: https://www.dataprivacyframework.gov/participant/5666.

Data processing

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required under data protection law that ensures the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

3. General information and mandatory information

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.

When you use this website, various personal data is collected. Personal data is data that can be used to identify you personally. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.

We point out that data transmission over the internet (e.g., when communicating by email) can have security gaps. Complete protection of data against access by third parties is not possible.

Information on the controller

The controller responsible for data processing on this website is:

LVIT GmbH Nördliche Münchner Str. 47 82031 Grünwald

Phone: +49 89 588088430 Email: [email protected]

The controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g., names, email addresses, etc.).

Storage period

Unless a more specific storage period has been stated within this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a justified request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g., retention periods under tax or commercial law); in the latter case, deletion takes place once these reasons no longer apply.

General information on the legal bases for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR, insofar as special categories of data are processed pursuant to Art. 9 (1) GDPR. In the case of explicit consent to the transfer of personal data to third countries, data processing is also carried out on the basis of Art. 49 (1) (a) GDPR. If you have consented to the storage of cookies or to access to information on your device (e.g., via device fingerprinting), the data processing is additionally carried out on the basis of § 25 (1) TDDDG. Consent can be revoked at any time. If your data is required for the fulfillment of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6 (1) (b) GDPR. Furthermore, we process your data insofar as it is required to fulfill a legal obligation, on the basis of Art. 6 (1) (c) GDPR. Data processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6 (1) (f) GDPR. Information on the legal bases relevant in each individual case is provided in the following paragraphs of this privacy policy.

Information on the transfer of data to third countries that are not secure under data protection law, as well as the transfer to US companies that are not DPF-certified

Among other things, we use tools from companies based in third countries that are not secure under data protection law, as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). When these tools are active, your personal data may be transferred to and processed in these countries. We point out that in third countries that are not secure under data protection law, a level of data protection comparable to that of the EU cannot be guaranteed.

We point out that the USA, as a secure third country, generally has a level of data protection comparable to that of the EU. A transfer of data to the USA is therefore permissible if the recipient holds a certification under the "EU-US Data Privacy Framework" (DPF) or has suitable additional safeguards. Information on transfers to third countries, including the data recipients, can be found in this privacy policy.

Recipients of personal data

In the course of our business activities, we work with various external parties. In some cases, this also requires the transfer of personal data to these external parties. We only transfer personal data to external parties if this is required within the framework of contract fulfillment, if we are legally obligated to do so (e.g., transfer of data to tax authorities), if we have a legitimate interest in the transfer pursuant to Art. 6 (1) (f) GDPR, or if another legal basis permits the data transfer. When using processors, we only transfer personal data of our customers on the basis of a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The lawfulness of the data processing carried out up to the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct advertising (Art. 21 GDPR)

IF THE DATA PROCESSING IS BASED ON ART. 6 (1) (E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 (1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT ADVERTISING (OBJECTION PURSUANT TO ART. 21 (2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work, or the place of the alleged violation. The right to lodge a complaint exists without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Information, correction, and deletion

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients, and the purpose of the data processing and, if applicable, a right to correction or deletion of this data. You can contact us at any time regarding this and other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time regarding this. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we generally need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data happened/is happening unlawfully, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data but you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection pursuant to Art. 21 (1) GDPR, a balancing of your interests and ours must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or for the establishment, exercise, or defense of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of an important public interest of the European Union or a member state.

SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator, this site uses SSL/TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser bar.

If SSL/TLS encryption is activated, the data you transmit to us cannot be read by third parties.

4. Data collection on this website

Cookies

Our web pages use so-called "cookies". Cookies are small data packets and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted after the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or your web browser deletes them automatically.

Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within web pages (e.g., cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, since certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies can be used to evaluate user behavior or for advertising purposes.

Cookies that are necessary to carry out the electronic communication process, to provide certain functions you have requested (e.g., for the shopping cart function), or to optimize the website (e.g., cookies for measuring the web audience) (necessary cookies) are stored on the basis of Art. 6 (1) (f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6 (1) (a) GDPR and § 25 (1) TDDDG); consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be limited.

If other cookies and services are used on this website, you can find this in this privacy policy.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

This data is collected on the basis of Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – for this purpose, the server log files must be recorded.

Contact form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6 (1) (b) GDPR, insofar as your inquiry is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of inquiries addressed to us (Art. 6 (1) (f) GDPR) or on your consent (Art. 6 (1) (a) GDPR), if this has been requested; consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request its deletion, revoke your consent to its storage, or the purpose for data storage no longer applies (e.g., after your inquiry has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected.

Use of AI on the website

We use AI-powered services and/or applications on our website.

When you interact with or come into contact with elements on our website that use artificial intelligence (e.g., a chatbot), your inputs including metadata are processed to generate a suitable answer or response.

The use of these AI-powered functions is carried out on the basis of Art. 6 (1) (f) GDPR. We have a legitimate interest in using modern technologies on our website to improve our offerings and services and to identify new potential from interaction with our customers. If consent is required, processing is carried out exclusively on the basis of Art. 6 (1) (a) GDPR and § 25 (1) TDDDG. You can revoke your consent at any time.

Further information on the data processing of this tool or service can be found at the relevant point in this privacy policy.

Use of Artificial Intelligence (AI) to respond to customer inquiries

We use AI-powered software to process and respond to customer inquiries. The AI we use analyzes the content of your message in order to generate a suitable answer or answer suggestion autonomously or partially autonomously. In this context, our AI processes all the contents of your message, including names, email addresses, communication content, or technical information (e.g., IP addresses, device information).

The use of the AI software is carried out on the basis of Art. 6 (1) (f) GDPR. We have a legitimate interest in customer communication that is as efficient as possible using modern technical solutions.

We use the following AI applications:

ChatGPT

We use ChatGPT for our customer communication. The provider is OpenAI, 3180 18th St, San Francisco, CA 94110, USA, https://openai.com. So when you contact us, your inquiries including metadata may be transferred to ChatGPT's servers and processed there in order to generate a suitable response.

We have configured ChatGPT so that the data we forward to ChatGPT is not used to train the ChatGPT algorithm.

You can find further information here: https://openai.com/policies/privacy-policy.

Data processing

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required under data protection law that ensures the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Inquiry by email, phone, or fax

If you contact us by email, phone, or fax, your inquiry, including all personal data arising from it (name, inquiry), will be stored and processed by us for the purpose of handling your request.

The data you send us via contact inquiries will remain with us until you request its deletion, revoke your consent to its storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions – in particular statutory retention periods – remain unaffected.

Use of chatbots

We use chatbots to communicate with you. Chatbots are able to respond to your questions and other inputs without human assistance. To do this, the chatbots analyze, in addition to your inputs, further data in order to provide suitable answers (e.g., names, email addresses and other contact details, customer numbers and other identifiers, orders, and chat histories). Furthermore, your IP address, log files, location information, and other metadata may be collected via the chatbot. This data is stored on the servers of the chatbot provider.

On the basis of the collected data, user profiles can be created. In addition, the data can be used to display interest-based advertising, provided the other legal requirements (in particular consent) for this are met. For this purpose, the chatbots can be linked to analysis and advertising tools.

The collected data can also be used to improve our chatbots and their response behavior (machine learning).

The data you enter in the course of communication will remain with us or the chatbot operator until you request its deletion, revoke your consent to its storage, or the purpose for data storage no longer applies (e.g., after your inquiry has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected.

The legal basis for the use of chatbots is Art. 6 (1) (b) GDPR, insofar as the chatbot is used to initiate a contract or in the context of contract fulfillment. Insofar as corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 (1) (a) GDPR and § 25 (1) TDDDG, to the extent the consent covers the storage of cookies or access to information on the user's device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time. In all other cases, the use is based on our legitimate interest in customer communication that is as effective as possible (Art. 6 (1) (f) GDPR).

Use of AI applications in the context of chatbot communication

Our chatbots use artificial intelligence (AI) in the context of customer communication. The AI we use analyzes the content of your message in order to autonomously generate a suitable response. In this context, the AI processes all the contents of your message, including names, email addresses, communication content, or technical information (e.g., IP addresses, device information).

The use of the AI software is carried out on the basis of Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in customer communication that is as efficient as possible using modern technical solutions. Insofar as corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 (1) (a) GDPR and § 25 (1) TDDDG. Consent can be revoked at any time.

We integrate the following AI applications into our chatbots:

ChatGPT

Our chatbots use ChatGPT for our customer communication. The provider is OpenAI, 3180 18th St, San Francisco, CA 94110, USA, https://openai.com. So when you contact us via chatbot, your inquiries including metadata may be transferred to ChatGPT's servers and processed there in order to generate a suitable response.

Google Tag Manager

We use the Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

The Google Tag Manager is a tool that allows us to integrate tracking or statistics tools and other technologies on our website. It merely serves to manage and deploy the tools integrated through it. However, the Google Tag Manager collects your IP address, which may also be transferred to Google's parent company in the United States.

The use of the Google Tag Manager is carried out on the basis of Art. 6 (1) (f) GDPR. Google Analytics enables the website operator to analyze the behavior of website visitors. In doing so, the website operator receives various usage data, such as page views, time spent, operating systems used, and the origin of the user. This data is assigned to the respective device of the user. No assignment to a user ID takes place.

Furthermore, with Google Analytics we can, among other things, record your mouse and scroll movements and clicks. In addition, Google Analytics uses various modeling approaches to supplement the collected data sets and uses machine learning technologies in data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g., cookies or device fingerprinting). The information collected by Google about the use of this website is generally transferred to a Google server in the USA and stored there.

The use of this service is carried out on the basis of your consent pursuant to Art. 6 (1) (a) GDPR and § 25 (1) TDDDG. Consent can be revoked at any time.

The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://business.safety.google/adscontrollerterms/sccs/.

Only in exceptional cases is the full IP address transferred to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide further services related to website use and internet use to the website operator. The IP address transmitted by your browser in the context of Google Analytics is not merged with other Google data.

Google Ads

The website operator uses Google Ads. Google Ads is an online advertising program of Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads enables us to display advertisements in the Google search engine or on third-party websites when the user enters certain search terms on Google (keyword targeting). Furthermore, targeted advertisements can be displayed based on the user data available at Google (e.g., location data and interests) (audience targeting). As the website operator, we can evaluate this data quantitatively, for example by analyzing which search terms led to the display of our advertisements and how many advertisements led to corresponding clicks.

The use of this service is carried out on the basis of your consent pursuant to Art. 6 (1) (a) GDPR and § 25 (1) TDDDG. Consent can be revoked at any time.

This information serves to create conversion statistics. We learn the total number of users who clicked on our ads and what actions they carried out. We do not receive any information that allows us to personally identify the user. Google itself uses cookies or comparable recognition technologies for identification.

The use of this service is carried out on the basis of your consent pursuant to Art. 6 (1) (a) GDPR and § 25 (1) TDDDG. Consent can be revoked at any time.

No further data is collected, or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The processing of the data entered in the newsletter registration form is carried out exclusively on the basis of your consent (Art. 6 (1) (a) GDPR). You can revoke the consent you have given to the storage of the data, the email address, and its use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter. The lawfulness of the data processing operations already carried out remains unaffected by the revocation.

The data you have provided to us for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe from the newsletter or after the purpose no longer applies. We reserve the right to delete or block email addresses from our newsletter distribution list at our own discretion within the scope of our legitimate interest pursuant to Art. 6 (1) (f) GDPR.

Data stored with us for other purposes remains unaffected by this.

After you unsubscribe from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist, if this is necessary to prevent future mailings. The data from the blacklist is used only for this purpose and is not merged with other data. This serves both your interest and our interest in complying with the legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 (1) (f) GDPR). We assure you that the collection, processing, and use of your data takes place in accordance with applicable data protection law and all other legal provisions, and that your data is treated strictly confidentially.

Scope and purpose of data collection

If you send us an application, we process your associated personal data (e.g., contact and communication data, application documents, notes in the context of job interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6 (1) (b) GDPR (general initiation of a contract) and – if you have given consent – Art. 6 (1) (a) GDPR. Consent can be revoked at any time. Your personal data will be passed on within our company only to persons involved in processing your application.

If the application is successful, the data you submit will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6 (1) (b) GDPR for the purpose of carrying out the employment relationship.

In the context of the application procedure, we may also carry out an internet search about you. This primarily includes the Google search, LinkedIn, and Xing. The legal basis for this type of processing is our legitimate interest in obtaining an overall impression of publicly accessible information about you pursuant to Art. 6 (1) (f) GDPR.

Retention period of the data

If we cannot offer you a position, you reject a job offer, or you withdraw your application, we reserve the right to retain the data you have transmitted on the basis of our legitimate interests (Art. 6 (1) (f) GDPR) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). Afterwards, the data is deleted and the physical application documents are destroyed. The retention serves in particular for evidentiary purposes in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g., due to an impending or pending legal dispute), deletion only takes place once the purpose for the further retention no longer applies.

A longer retention may also take place if you have given corresponding consent (Art. 6 (1) (a) GDPR) or if statutory retention obligations preclude deletion.

Inclusion in the applicant pool

If we do not offer you a position, there may be the possibility of including you in our applicant pool. In the case of inclusion, all documents and information from the application are transferred to the applicant pool in order to contact you in the event of suitable vacancies.

Inclusion in the applicant pool takes place exclusively on the basis of your express consent (Art. 6 (1) (a) GDPR). Giving consent is voluntary and is not related to the ongoing application procedure. The data subject can revoke their consent at any time. In this case, the data is irrevocably deleted from the applicant pool, provided there are no legal retention grounds.

The data from the applicant pool is irrevocably deleted no later than two years after consent is given.
